Abstract
In the democratic society, everyone is entitled to a fair and public hearing by an independent and impartial tribunal established by law. In order to ensure the right to fair trial, the civil defendant has the right to defence against the plaintiff’s claims. On this basis, the defendant has the opportunity to file objections against the plaintiff’s claims and to make counter claim to offset a previous claim.
