At present, the effective way to combat cross-border and transnational crime must involve a regional and international dimension, in addition to the national dimension, through the united convergent action of the judiciary bodies in all countries. The most commonly used varieties of incitement actions can be found in practice in combination with certain complex fables, representing an integral process that initially, by its essence, has certain criteria that indicate the violation of the law on special investigative activity. Incitement, facilitating or encouraging the person to commit the crime is a prejudicial action, and regardless of the reasons that determined these actions or the purpose pursued, it cannot be admitted. Thus, in the criminal proceedings, the data obtained by incitement, facilitating or encouraging the person to commit the crime cannot be admitted as evidence and, therefore, are excluded from the file, as they cannot be presented in court or serve as basis for the sentence or other court decisions.Item Interogarea inculpatului minor [Articol](USARB, 2005) Rusu, VitalieThe confession of a minor defendant contributes to the complete determination of those essentially necessary for the case, if of course it is not false. The law court should obtain an adequate answer to the given question. This plays a great role for the establishment of the psychological contact with the accused which is especially significant when examining the cases of minor offenders. The veracity of the defendant’s confession during the entire judicial investigations, depends on the frankness of the answer and the recognition of the accusation. If, because of any reason, the minor doesn’t accept the accusation or he is blocked as a result of an emotional tension refusing to give an adequate testimony, then it is quite difficult to get the truth. The regulations on localization or tracking through the Global Positioning System (GPS) are not an exception as well. The localization or tracking through the global positioning system should only be used if there are serious grounds for believing that a serious crime has been committed or is prepared or is being prepared by one or more specifically identified persons, or by one or more persons or a group of people who have not yet been identified. Regarding the authorization of interference in case of suspicion regarding the preparation of a crime, the legislator gave effectiveness to the principles of proactive investigation, which have a wide application in various legal systems. At the same time, in order to guarantee the principle of proportionality, when ordering the use of special techniques to which localization or tracking through the global positioning system is assigned, this use must be assessed according to the seriousness of the offenses and considering the intrusive nature of the technique used.Item Particularităţi ale acţiunilor de urmărire penală în cazul infracţiunilor comise de grupele criminale organizate [Articol](USARB, 2022) Rusu, Vitalie; Jitariuc, VitalieA considerable part of the crimes committed today (in particular, in the sphere of banking, commerce, finance, etc.) are committed by well-organized criminal groups. The criminal activity of organized criminal groups is encountered, in the practice of law enforcement bodies and in specialized doctrinal sources, under the name of "organized crime". Criminological and criminalistic researches show us that organized criminality in the Republic of Moldova, but also in other states, register a new qualitative level of professional group crime, with its specific features. These, however, unfortunately, are still not properly studied by the science of forensics; they are not reflected in the texts of recommendations on the methodology of investigating crimes committed by organized criminal groups. Meanwhile, without taking into account the forensic characteristics of organized criminal groups and, in particular, the particularities of their criminal activity, the application of existing methodologies for investigating crimes committed by organized criminal groups is not always effective. However, at the moment, in the process of investigating crimes committed by organized criminal groups, the representatives of the law enforcement bodies are faced, most often, with tactical-methodological difficulties.Item Particularităţi privind organizarea şi planificarea cercetării infracţiunilor de terorism [Articol](USARB, 2024) Rusu, Vitalie; Secrier, AlexandrThe development and improvement of the methodology for the investigation of terrorist crimes is a topical issue of the forensic science. The analysis of the specialized literature shows that the research into the phenomenon of terrorism has been going on for a long time. However, the legal doctrine examined, for the most part, the criminal law and forensic aspects of terrorism. At the same time, we note a certain lack of forensic literature dedicated to the methodology for the investigation of terrorist crimes. This state of affairs is largely due to the lack of a justified scientific methodology regarding the investigation of such crimes, a fact that determines the insufficient professional training of the representatives of law enforcement bodies. The absence of efficient methodological recommendations in this field, the objective need for the scientific development of an appropriate methodology for the investigation of the acts of terrorism, the theoretical and practical importance of this issue and its insufficient reflection in the forensic doctrine determined the scientific research of the subject regarding the organization and planning of the investigation of terrorist crimes.Item Reflecții asupra instituției investigatorului sub acoperire conform prevederilor legii Republicii Moldova „privind activitatea specială de investigații” nr. 59 din 29.03.2012 [Articol](USARB, 2016) Rusu, VitalieA special interest, today, has the authorization of special measures of investigation by the prosecutor, in its quality of basic guarantee to ensure the constitutional rights and freedoms and of the mechanism effective to ensure legality in the work of the special investigation.
