    The Constitution of Moldova is oriented towards the creation of a contradictory system of criminal justice, which necessarily involves the necessity of realization of some contradictory beginnings at the prosecution stage. Despite of this fact, the Code of criminal procedure of Moldova, implemented in June 12th, 2003, in terms of contradictory did not change the criminal process of our country at the desired level. Nowadays, in front of the legislator of Moldova there exists the same tasks and problems which kneaded our society during many reforms in the realm of justice. The main problem of time is the low efficiency of criminal justice in the sphere of combating crime, as well as in terms of protecting the rights and legitimate interests of participants to the criminal procedure activity.

    Principiul contradictorialității în procesul penal al unor state din sistemul de drept anglo-saxon [Articol]

    The multiple operations performed in the last period of time in the criminal procedure law of the Republic of Moldova did not have in view the subject of adversariality which, as the legislator considers, applies not only to the examination of the cases in the court, but also in the pre-trial phases of the criminal trial. At the same time, the contemporary activity of criminal proceedings is continuously improving in the side and in the direction of the adversariality. As a result of this fact, not only the trial phases of a criminal case, but also the pre-trial ones acquire an adversarial form and content. For adversariality to exist between the procedural subjects, they need to be constantly informed about the evidence in the file, which is not always possible, because the legal provisions regarding confidentiality would be violated.

    In connection with the judiciary system reforming and changes in socio-political life in our state, the adversarial principle has gained a new resonance on the grounds that the judicial and legal reform is directly linked to adversariality. The reform of the criminal procedure law must be based on solid theoretical foundation. However, adversariality, as legal concept, is not enough investigated in the doctrine of the criminal procedure law. The Criminal procedure law of the Republic of Moldova is advancing and developing through democratization and widening of adversariality beginnings in justice rendering.
