    Analiza particularităţilor dezvoltării sistemului de asigurare obligatorie de asistenţă medicală din Republica Moldova [Articol]

    This article aims to analyze one of the specific elements in the field of public health - the compulsory health care insurance system of the Republic of Moldova - in order to highlight its evolution and particularities from the moment of its implementation to the present, analyze the achievements and challenges it faces, as well as to relate it to the EU health strategy. The scientific approach aims to highlight the challenges of the transition from the Semashko model of health care, existing at the national level until 2004, to the Bismarck model of health insurance, to analyze the evolution of health policy documents in order to highlight the state's optics at different stages of the reforms carried out, to examine the achievements of the compulsory health care insurance system, as well as the problems that remained unsolved during the two decades of the implementation of the Bismarckian model of health care at the national level.

    Analiza reglementărilor privind respectarea dreptului la protecție socială în caz de pierdere a întreținătorului [Articol]

    In der Republik Moldau, wie in den meisten post-sowjetischen Ländern, wurde der Übergang von dem Sozialversicherungssystem des Bng-Typs zu der Bismarck- Sozialversicherung von der Wirtschaftskrise, der Minderung des Pro-Kopf-Einkommens und der Beschäftigungsrate, des Wachstums der Armutsquote stark beeinflusst- Phänomene, die einen massen- und dauerhaften Charakter erzielten. Diese Faktoren regten die nationale Legislative und Exekutive an, das sowjetische Sozialversicherungssystem in dem Zusammenhang eines akuten Haushaltsdrucks und Mangels an finanziellen Ressourcen zu reformieren. Der vorliegende Artikel enthält eine durchgeführte Studie mit dem Ziel, die Effektivität der Sozialversicherungsgarantien, bereitgestellt an Personen, die ihren Sozialversicherungsträger verloren haben, auszuwerten, als auch die positiven und negativen Aspekte bezüglich der Durchsetzung dieses Rechts zu identifizieren sowie maßgeschneiderte Vorschläge für die geltende Gesetzgebung zu umreißen.

    Cadrul juridic și mecanismele internaționale de cooperare transfrontalieră și transnațională în materie penală [Articol]

    International legal cooperation by law enforcement institutions is based on international agreements, bilateral or multilateral, concluded with other states, as well as on the ratification of international conventions, which regulate a number of legal institutions with applicability in preventing and combating violent crimes. At present, the effective way to combat cross-border and transnational crime must involve a regional and international dimension, in addition to the national dimension, through the united convergent action of the judiciary bodies in all countries. Although most states have laws to combat crime and punish perpetrators, they prove being insufficient to effectively and efficiently counter the phenomenon of transnational crime, as combating crime at the national level, however competent, remains an action with limited influence opposed to the international character of the phenomenon.

    Conferinţa ştiinţifico-internaţională „Justiţia – pilon fundamental al edificării statului de drept” a fost organizată de Catedra de drept a Universităţii de Stat „Alecu Russo” din Bălţi. La activitate au participat cadre ştiinţifico-didactice din instituţii universitare şi preuniversitare din Republica Moldova, obiectivul principal al conferinţei fiind – analiza problemei justiţiei ca pilon fundamental al edificării statului de drept. În discursurile participanţilor au fost reliefate un şir de probleme cu care se confruntă la ora actuală justiţia.

    Problematica înaintării şi examinării acţiunilor civile privind pensia de întreţinere [Articol]

    This article examines the issue of the initiation and examination of civil actions for the collection of child maintenance, the latter being a logical reflection of the guarantee and respect for the fundamental rights and interests of the child through the direct participation of the state in this matter. The article analyzes the particularities of the judicial procedures for the collection of maintenance and highlights their advantages and disadvantages, taking into account the social-economic, political and legislative factors in the Republic of Moldova. Following the elucidation of the practical aspects, as well as the comparative analysis of the legislation of other countries in the field, the research reveals the imperfections of the legal norms.

    Reflecţii privind particularităţile reformei sistemului de asigurări sociale [Articol]

    Social insurance is any government-sponsored program with the following four characteristics: the benefits, eligibility requirements and other aspects of the program are defined by statute; explicit provision is made to account for the income and expenses; it is funded by taxes or premiums paid by (or on behalf of) participants (although additional sources of funding may be provided as well); the program serves a defined population, and participation is either compulsory or the program is heavily enough subsidized that most eligible individuals choose to participate. Social insurance has also been defined as a program where risks are transferred to and pooled by an organization, often governmental, that is legally required to provide certain benefits. This article represents the scientific analysis of national system of social insurance in which its characteristics and feature have been revealed and analyzed.
