Particularităţi ale acţiunilor de urmărire penală în cazul infracţiunilor comise de grupele criminale organizate [Articol]
(USARB, 2022) Rusu, Vitalie; Jitariuc, Vitalie
A considerable part of the crimes committed today (in particular, in the sphere of banking, commerce, finance, etc.) are committed by well-organized criminal groups. The criminal activity of organized criminal groups is encountered, in the practice of law enforcement bodies and in specialized doctrinal sources, under the name of "organized crime". Criminological and criminalistic researches show us that organized criminality in the Republic of Moldova, but also in other states, register a new qualitative level of professional group crime, with its specific features. These, however, unfortunately, are still not properly studied by the science of forensics; they are not reflected in the texts of recommendations on the methodology of investigating crimes committed by organized criminal groups. Meanwhile, without taking into account the forensic characteristics of organized criminal groups and, in particular, the particularities of their criminal activity, the application of existing methodologies for investigating crimes committed by organized criminal groups is not always effective. However, at the moment, in the process of investigating crimes committed by organized criminal groups, the representatives of the law enforcement bodies are faced, most often, with tactical-methodological difficulties.
