    The present paper analyzes the provisions of Moldovan law concerning the rules on the right of withdrawal in consumer contracts. The study focuses on the duration and start of the withdrawal period, extension of the withdrawal period for failure to provide information on the right, exercise of the right, the effects of withdrawal on the obligations of the trader and the consumer and on ancillary contracts, and the exceptions to the right.

    The present study analyzes the credit agreement for consumers in the light of the amendments to the law no. 202 of 12.07.2022, in force from 29.05.2022. The study focuses, in particular, on the new provisions and its impact on consumer protection, including the analysis of case law from Tribunals, Courts of Appeal and from Supreme Court.

    Considerații privind obligațiile locatorului în contractul de locațiune [Articol]

    The conclusion of a lease contract create rights for both lessor and lessee and it also imposes on these parties certain reciprocal obligations specified by law, which the parties can however agree to cancel, mitigate, or increase in the lease contract. The present paper briefly analyzes the obligations of the lessor in the lease contract, pointing out the relevant provisions of the modernized Civil Code of Republic of Moldova and taking into account other provisions in the legislation.

    The present study briefly analyzes the insurance contract regulated by the Civil Code of the Republic of Moldova and other special laws. Particular aspects of the insurance contract will be outlined, including legal characters and classification. In addition, some new provisions concerning the insurance contract will be analyzed, pointing out some particular aspects concerning the legal characters and the classification.

    Consideraţii privind varietăţile contractului de depozit [Articol]

    The present study briefly analyzes the types of storage contract regulated by the Civil Code of the Republic of Moldova. Some particular aspects of thesee types of storage contract will be outlined, including a comparative analysis (other legislations and the provisions of the DCFR (Draft Common Frame of Reference)). In addition, some new provisions concerning the storage contract introduced by the Law on Modernization of the Civil Code will be analyzed, pointing out some particular aspects and gaps of the new provisions.

    Contractele privind pachetele de servicii de călătorie și serviciile de călătorie asociate în reglementarea directivei 2015/2302/UE [Articol]

    The present paper briefly analyzes the provisions of Directive 2015/2302/EU on package travel and linked travel arrangements. The study focuses on the main changes proposed in the new text, comparing them with the provisions of the old Directive 90/314/EEC, which was repealed on 01.07.2018. It also highlights the role of the new Directive in achieving a higher level of consumer protection.

    The present paper briefly analyzes the provisions of the Amended proposal for a Directive of the European Parliament and of the Council on certain aspects concerning contracts for sales of goods. The study focuses on the main changes proposed in the new text, comparing them with the provisions of the Directive 1999/44/EC, which will be repealedif the proposal will be approved. It also highlights the role of the amendedproposal for a Directivein achieving a higher level of consumer protection.

    Despre revocarea contractului de donație în lumina noilor reglementări aprobate prin legea privind modernizarea codului civil [Articol]

    The present paper briefly analyzes the new provisions of the Civil Code of the Republic of Moldova concerning the rules on the right of the donorto revoke the donation. The study critically analysethe revocation for ingratitude, revocation for the unjustified non-fulfillment of conditions or charges, revocationin case of impoverishment of the donorand residual right to revoke the donation. It also highlights the time limits for revoking the donation, the effects of revoking, pointing out some particular aspectsand gapsof the new provisions.

    Dreptul consumatorului de a fi informat [Articol]

    This article considers the right of the consumers to be informed about all contractual conditions before the conclusion of the contracts. This right states that businesses should always provide consumers with enough appropriate information to make intelligent and informed product choices. Product information provided by a business should always be complete and truthful. Aiming to achieve protection against misleading information in the areas of financing, advertising, labeling, and packaging, the right to be informed is protected by the Law n. 105 of 13 march 2003. Considering the objective of European integration of Republic of Moldova highlights the necessity of the adaption of the Moldovan legislation concerning the consumer protection to the legislation of European Union.

    This article aims to analyze the provisions of the Directive (EU) 2019/771 on certain aspects concerning contracts for sales of goods, applicable to contracts concluded from 01.01.2022. The study focuses on the rules governing the requirements for conformity of the goods and the modalities for the consumers to exercise the remedies in the event of a lack of conformity of the goods.
