    The state should inform the business environment in particular, but also the society in general about the possibility and existence of alternative conflict resolution services such as mediation and arbitration. The arbitration presents the chance not to submit to an excessive formalism which often suffocates the efficient and expeditious conduct of a dispute. Thus, subject to the mandatory provisions of law, public order or good manners, the parties may establish, by arbitration agreement or by a separate act, rules of procedure to be followed by the arbitral tribunal in the resolution of the dispute.
