    Juvenile delinquency is a complex and serious social phenomenon due to its negative consequences not only for the community, but also for the future of the juvenile. The reality shows that, within the general criminal state, there is a fairly well-defined sector of the criminal activity committed by juveniles. The law cannot ignore this reality, but neither can it look at and regulate from the same angle the criminal activities committed by minors, both regarding the degree of social danger of the act, as well as regarding the investigation and judgment of the acts committed by this category of persons. Hence the need for special rules applicable to minors, both in relation to the limits of criminal liability and in the investigation of the acts committed by those under the age of majority. In other words, in the case of juvenile offenders, a mechanism for investigating and judging their acts must be applied, different from the one provided for and applicable to the major offender.
